Law Firm of Michael L. Davidson Sets Court Precedent, Questions Integrity of California DUI Breath Tests
February 2, 2011, Law Firm of Michael L. Davidson received positive news. The San Francisco criminal defense firm set a precedent with the California courts that opened the door for criminal defendants across the state of California facing DUI charges.
In 2008, Michael L. Davidson and James E. Dunn of the firm questioned the accuracy of a DUI breath test in Brenner v. Department of Motor Vehicles - and won.
The case climbed all the way up to the California Supreme Court. In February 2, 2011, the Court denied the request to hear the Department of Motor Vehicles appeal, thereby allowing the lower court's decision ruling in favor of their client to stand and take precedent.
The case decision will now offer an opportunity for California drivers to dispute the accuracy of a breath test and avoid unfair DUI charges and penalties associated with the violation.
