Two Types of License Suspensions
If you are charged with DUI in California, you are facing two separate, overlapping procedures through which your driver's license can be suspended or revoked: your criminal trial and an administrative process at the Department of Motor Vehicles (DMV).
- Criminal suspension: If you are convicted of DUI in criminal court, your license will be suspended for at least six months. Depending on the specific allegations you are convicted of, your license could be suspended or revoked for up to five years.
- Administrative suspension: The DMV can suspend your driver's license for four months after a first-time DUI arrest. For a subsequent charge, your license can be suspended for one year. For breath test refusal, you can lose your license for one to three years.
If you have been arrested for DUI and the officer took away your license, you have 10 days to request a DMV hearing. It is important to request a hearing, since this is generally your first opportunity to get your license back and challenge some of the evidence against you.
